Please read these Terms of Service ("Terms") carefully before using the Thumify website at thumify.net (the "Service") operated by Thumify ("us", "we", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Account Registration

• You must provide accurate, complete information when creating an account.
• You must be at least 13 years of age to use this Service.
• You are responsible for maintaining the security of your password.
• You are responsible for all activity that occurs under your account.
• You may only create one free account per person. Creating multiple accounts to obtain additional free credits is prohibited.

3. Credits and Usage

• Free Credits: Each new account receives 15 free credits as a one-time gift. Credits cannot be transferred between accounts.
• Credit Use: Each AI image generation or edit consumes 1 credit. Credits are deducted upon successful generation.
• No Refunds on Credits: Used credits are non-refundable. Credits have no cash value.
• Expiry: Free credits do not expire. Pro subscription credits refresh monthly and do not roll over.

4. Acceptable Use

You agree NOT to use the Service to generate content that:

• Depicts minors in sexual or inappropriate situations
• Contains explicit violence, gore, or graphic content designed to shock or harm
• Constitutes hate speech based on race, religion, gender, sexual orientation, nationality, or disability
• Infringes on the intellectual property rights of others
• Intentionally misleads or deceives viewers (deepfakes of real individuals without consent)
• Promotes illegal activities or products
• Is used to spam, harass, or harm others

Violation of these rules may result in immediate account suspension without credit refund.

5. Intellectual Property

Your Content: You retain ownership of any images you upload and the prompts you write.

Generated Images (Free Plan): You may use generated thumbnails for personal, non-commercial creative projects such as your own YouTube channel or personal Instagram account.

Generated Images (Pro Plan): Pro subscribers receive a commercial license to use generated images in commercial projects, including client work, paid advertising, and monetized channels.

Thumify Platform: The Thumify website, logo, design, code, and brand are exclusively owned by Thumify. You may not copy, reproduce, or redistribute any part of our platform.

6. AI-Generated Content Disclaimer

AI-generated images are created by automated systems. Thumify does not guarantee that generated content will be accurate, appropriate for all audiences, or free from unintended similarities to existing works. You are responsible for reviewing generated content before publishing. Thumify bears no liability for how you use generated images.

7. Service Availability

We aim to maintain 99%+ uptime but do not guarantee uninterrupted access. We may perform maintenance that temporarily limits access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by law, Thumify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service, including loss of data or profits.

Our total cumulative liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Termination

We may terminate or suspend your account for violation of these Terms, without prior notice. You may delete your account at any time by contacting support@thumify.net. Upon termination, your credits and generated history will be permanently deleted.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and changing the "Last updated" date. Continued use of the Service constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
